Abstrakt Tento článek pojednává o dohledu nad finančním trhem. Jsou v něm vymezena zejména kritéria uspořádání dohledu nad finančním trhem, druhy cílů, jež jsou v rámci dohledu sledovány, a nastíněny také základní modely, do nichž jsou dohledové orgány uspořádány. Následně je přiblížen vývoj organizace dohledu nad finančním trhem v Nizozemí, které je příkladem země, která zvolila model uspořádání dohledu nad finančním trhem nazývaný jako twin peaks. Tento model autor označuje za vhodný ke zvážení jako model v budoucnosti využitelný v České republice.
The article is focused on a financial market supervision. Criteria of supervision organisation, main aims of supervision and fundamental models of supervision organisation are specified in the article. Later, the supervision organisation in the Netherlands (that can be found as an example among countries having so called twin peaks model of supervision) is described. According to the opinion of the author the twin peaks model can be considered as a suitable kind of supervision organisation for future of the Czech Republic.

Abstrakt Tento článek se zaměřuje na problematiku uložení odvodu za porušení rozpočtové kázně a jeho povahy jako trestní sankce pro účely aplikace čl. 6 a 7 Evropské úmluvy o ochraně lidských práv a základních svobod. Autor nejprve analyzuje vybranou judikaturu Evropského soudu pro lidská práva a tuzemských soudů. Následně jsou judikaturní závěry aplikovány na institut odvodu za porušení rozpočtové kázně a vyvozuje dopady, která povaha tohoto odvodu jako trestní sankce přinese do aplikační praxe, a to především s ohledem na častý souběh řízení o stanovení odvodu a uložení pokuty Úřadem pro ochranu hospodářské soutěže.
This article is focused on the issue of the imposition of the charge for breach of budgetary discipline and its nature as a criminal sanction for the purposes of the application of the articles 6 and 7 of the European Convention for the Protection of Human Rights and Fundamental freedoms. The author analyses the selected case law of the European Court of Human Rights and Czech courts first. Then, these conclusions from the case law are applied on the institution of the charge for breach of budgetary discipline and the author deduces impacts which the criminal nature of this charge brings to the legal praxis. The special attention is devoted to the possible concurrence of the proceedings for the imposition of this charge and the proceedings for the imposition of the fine by the Czech Office for the Protection of Competition.

Abstrakt Tento článek se zabývá porušením rozpočtové kázně, které následuje v důsledku neoprávněného použití či zadržení peněžních prostředků z veřejných peněžních fondů. Autor tohoto článku se věnuje pouze některým otázkám spojeným s porušením rozpočtové kázně zásadním z pohledu autora, když komplexní vymezení této problematiky by bylo zcela nad rámec tohoto článku. První část článku je zaměřena na vymezení základních pojmů, jakým je samotné porušení rozpočtové kázně, veřejné peněžní prostředky a určení porušitelů, které se mohou dopustit porušení rozpočtové kázně. Následuje stěžejní část věnována postupu při porušení rozpočtové kázně, kdy se autor zamýšlí nad některými aspekty tohoto postupu. Cílem tohoto článku je zhodnotit právní úpravu porušení rozpočtové kázně a navrhnout případně řešení pro futuro.
This article deals with the breach of budgetary discipline as a result of unauthorized use or retention of funds provided from public money funds. Author focuses only on certain issues related to the breach of budgetary discipline, which are essential according to the author. In first part of the article author defines basic terms as the breach of budgetary discipline, public fund and identification of the entities, which may breach budgetary discipline. Main part of this article is dedicated to the procedure about the breach of budgetary discipline. Author deals with some of crucial aspects of this process. The aim of this article is to evaluate the legal regulation of the breach of budgetary discipline and propose solutions for the future.

The determination of tax residence of individuals in the context of Czech and international law

Abstrakt Článek se zabývá pravidly pro určení daňové rezidence poplatníka, fyzické osoby, z pohledu českých a mezinárodních předpisů. Rezidence poplatníka je podstatná pro stanovení výše daňové povinnosti v konkrétní zemi – rezident podléhá v dané zemi zdanění svých celosvětových příjmů, nerezident pouze z příjmů ze zdrojů na území daného státu. Podle českých předpisů se daňová rezidence poplatníka stanoví s pomocí kritéria bydliště a obvyklého pobytu na území České republiky. Smlouvy o zamezení dvojímu zdanění určují rezidenci v případě konfliktu tzv. dvojí rezidence. Konflikt je řešen pomocí pravidel, které zohledňují vztah poplatníka k danému státu. Pojmy používané k určení rezidence jak na národní tak mezinárodní úrovni musí být vykládány i s pomocí výkladů státní správy, komentáře k modelové smlouvě a soudních rozhodnutí.
This paper deals with the rules relevant for determination of tax residence of individual tax payer, both from the Czech and international viewpoint. Determination of the tax residence is important for calculation of the amount of tax to be paid in the country – tax resident is subject to worldwide taxation, unlike tax non-resident is subject to taxation of income from sources only. Under the Czech law, the tax residence of individual is determined with criteria of place of residence and habitual abode in the Czech Republic. OECD tax convention on income and capital deals with determination of tax residence in case of so called dual residence conflict, meaning that two countries consider the individual to be tax resident according to their national legislation at once. This conflict is to be solved using rules, considering links of the tax payer to the country. Terms used for determination of the tax residence both at national and international level have to be interpreted also in line with commentary to the OECD model convention on income and capital, commentary of state administration and court’s judgments.

Abstrakt In the post crisis period the main conundrum regulators have been trying to solve is how to unwind too big to fail entities without the adverse effects on the rest of the market participants. The Capital Requirements Regulation, the Bank Recovery and Resolution Directive, and the Dodd-Frank Act are the key tools serving to that purpose within the European Union and United States territory. The reaction from both sides of Atlantic seems similar in many ways, over thousand pages with the same underpinnings, i.e. protecting taxpayers' and consumers’ money, yet the deployed means to attain the end differ. The paper will thus focus on comparison and analysis of some aspects the two newly created crisis management regimes of systematically important entities.
