Abstrakt Tento článek se zaměřuje na problematiku charakteru daně z hazardních her ve světle aplikace smluv o zamezení dvojího zdanění vycházejících z modelové smlouvy OECD. Článek nejprve seznamuje čtenáře s vymezením působnosti aplikace těchto smluv na oblast jednotlivých národních daní a vykládá jednotlivá související ustanovení modelové smlouvy OECD. Poté se článek v krátkosti zabývá povahou důchodových přímých daní pro následnou aplikaci zjištěných závěrů na daň z hazardních her. Ve světle aplikace těchto závěrů je pak vyhodnoceno, zdali se související smlouvy o zamezení dvojího zdanění mají aplikovat také na daň z hazardních her.
This article focuses on the issue devoted to the characteristic of the tax on hazard games and the potential application of the double taxation treaties based on the OECD model treaty on this tax. At the beginning, the article familiarizes the reader with the definition of the scope of the application of such double taxation treaties on national taxes and interprets particular provisions of the OECD model treaty. Then, the article targets nature of the income direct taxes for the following application of identified conclusions on the regulation of Czech tax on hazard games. In the light of such conclusions, it is evaluated, if the corresponding double taxation treaties shall be applicable also on the Czech tax on hazard games.

Abstrakt Účelem tohoto textu je posoudit, zda regulace daňového práva procesního splňuje požadavky kladené na ni principem proporcionality či zda plnění zákonných povinností v této oblasti nepřiměřeně zatěžuje daňový subjekt. Uplatňování principu proporcionality při aplikaci a interpretaci daňového práva je prezentováno na judikatuře Ústavního soudu a Nejvyššího správního soudu. Co se týče samotné legislativy, byla provedena analýza ustanovení daňového řádu upravujících lhůty. Na základě provedených poznatků je možné konstatovat, že se zde objevují prvky, které zvýhodňují postavení správce daně na úkor daňového subjektu. Příkladem můžou být nepřiměřeně krátké lhůty pro úkony daňového subjektu, absence sankcí pro případ nedodržení lhůt správcem daně či absence samotných lhůt pro některé jeho úkony, jimiž může významně ovlivnit finanční situaci daňových subjektů, a to až na hranici jejich existence schopnosti. Situace vede k nepřípustným průtahům při rozhodování o právech a povinnostech adresátů právní normy, proto by měla být překlenuta interpretací, nebo přímo revizí dotčených ustanovení, a to především za použití nástroje, které orgánům státní moci dávají právě kritéria principu proporcionality.
The purpose of this text is to determine whether the regulation of procedural tax law meets the requirements of the proportionality principle or whether the fulfillment of legal obligations in this area disproportionately burdens the taxpayer. The use of the proportionality principle in the application and interpretation of tax law is presented in the case law of the Constitutional Court and the Supreme Administrative Court. As regards the legislation itself, an analysis of the provisions of the Tax Code governing the deadlines was carried out. On the basis of the findings, it is possible to state that there are elements that favor the position of the tax administrator at the expense of the tax entity. Examples include disproportionately short deadlines for the tax entity's actions, the absence of penalties for failure to comply with deadlines by the tax administrator or the lack of time limits for some of its operations that can significantly affect the financial situation of taxpayers, up to the limit of their ability to exist. The situation leads to undue delays in deciding on the rights and obligations of the addressees of the regulation, and should therefore be overcome by interpretation or directly by revising the respektive provisions, in particular by using a tool given to the state authorities by criteria of the proportionality principle.

Abstrakt Ve svém článku se autor zabývá novou právní úpravou v oblasti rozpočtového práva České republiky. Podrobněji analyzuje dopady nového zákona o pravidlech rozpočtové odpovědnosti, který nabyl své platnosti na začátku roku 2017 a který je svým charakterem zcela novým druhem rozpočtové právní úpravy. Tento nový zákon však podle názoru autora článku přináší, i díky způsobu průběhu legislativního procesu a formy, v jaké nakonec byla celá právní regulace pravidel rozpočtové odpovědnosti přijata, několik problematických dopadů na rozpočtovou samostatnost obcí. Podle názorů autora dokonce jeden z nich, a to povinnost sestavit rozpočet obce na základě výsledků rozpočtového hospodaření jiných subjektů, se může oprávněně jevit jako nikoliv souladný s ústavním pořádkem České republiky.
In his article the author deals with the new Czech legal regulation in the branch of budgetary law. He closely analyses influences and results of the new Act on Budgetary Responsibility Rules that was adopted at the beginning of 2017 and is a completely new kind of budgetary regulation concerning its characteristics. Unfortunately, according to the opinion of the author, the act brings several negative and problematic effects on budgetary independency and sovereignty of municipalities, which is influenced by the legislation process the bill of the act had to went through and by the legal form of the act itself that is not constitutional act as was originally intended. According to the author’s opinion one of the effects, the obligation to establish the municipal budget pursuant the budgetary management results of different public subjects, can be even considered as being contrary to the Czech Constitution.

Abstrakt Příspěvek se zabývá obecnými otázkami souvisejícími s nastavením daňového systému jako celku, a to v návaznosti na ostatní součásti hospodářské politiky. Svým zaměřením jde o téma na pomezí práva, ekonomie a hospodářské politiky. Představeny jsou také méně diskutované, však neméně důležité, funkce daní. Článek poukazuje na některé nedostatky současného daňového systému České republiky. Především pak na nezdravou skladbu našich daní upřednostňující nepřímé zdanění na úkor přímého. Takové rozložení je vhodné pro rozvíjející se, nikoliv vyspělé ekonomiky. Prohlubuje navíc příjmovou nerovnost, obecně vnímanou jako nežádoucí jev.
This paper deals with general issues related to complex setting of taxation system which should be treated as an important part of Economic policy. It is a topic permeating to Law, Economics and Public administration. The article presents shortcomings of current taxation system and introduces also it’s less discussed however no less important functions. As a main drawback it is considered tax structure which heavily favors indirect taxation. Such distribution is suitable for developing economies but not for developed ones. Moreover it instigates income inequality generally considered as undesirable effect.

Abstrakt Fantasy sports are popular games, where players can manage their virtual sport teams, whose performance is based on real-world statistics of athletes “drafted” into these teams. Traditionally, fantasy sports are played over a whole season. However, in the past few years, daily fantasy sports emerged as a short-term variant of fantasy games played over the Internet. Even though the daily fantasy games can be played for free, more often they are paid entry games. This article focuses on daily fantasy games, which are available through the Internet in the Czech Republic and discusses the question whether Czech gambling regulation and taxation applies to these games.
