Abstrakt Autor tohoto článku se zabývá problematikou nové formy peněz, tj. tzv. central bank digital currency (CBDC), jejíž možné vytvoření je v posledních letech zmiňováno ve vyjádřeních centrálních bankéřů. Tato nová forma peněz, v názvu článku pro zjednodušení označovaná jako elektronická hotovost, zcela jistě ovlivní fungování bankovního sektoru a bude představovat nový měnověpolitický nástroj. Jelikož česká finančněprávní věda se dosud blíže problematikou CBDC nezabývala, autor si za svůj hlavní cíl dal provést finančně-právně teoretické vymezení této nové formy peněz. Za účelem tohoto vymezení nejprve vybral několik kritérií, které posuzoval u stávajících forem peněz, a následně tyto hodnotil i ve vztahu k CBDC. V neposlední řadě autor uvažoval nad českým označením CBDC a položil několik otázek, kterými by se dle jeho názoru měla zabývat teorie finančního (a zejména měnového) práva.
This article deals with the issues regarding a new form of money, i.e. central bank digital currency (CBDC), which might, according to numerous recent statements by the central bankers around the world, be soon created. This new form of money, called electronic cash in the title of this paper, will very likely influence the functioning of the banking sector and will represent a new monetary policy tool. As the Czech financial law theory has not focused in much detail on the issues relating CBDC, yet, the author set an objective to outline the core financial law theoretical features of this new form of money. In order to do so, he first selected several criterions, which he analyzed with respect to the existing forms of money, so that he could later compare the findings with CBDC. Last but not least, the author pondered how CBDC could be called in Czech and he outlined a several issues which, in his opinion, should be further analyzed by the theory of financial (mainly monetary) law.

Abstrakt Jednou z technik analýzy dat, které má správce daně k dispozici, je data mining neboli vytěžování dat. Pomocí vytěžování dat je možné v dostupných datech nalézt nové informace a souvislosti, které v nich byly doposud skrytě obsaženy. Vytěžování dat je tak užitečnou technikou usnadňující správu daní. Na druhou stranu toto vytěžování zasahuje do soukromí daňových subjektů. Pokud jsou navíc předmětem vytěžování informace o fyzických osobách, představuje toto vytěžování zpracování osobních údajů. Článek se zaměřuje na právní úpravu, která se dotýká vytěžování dat o daňových subjektech a dalších entitách, které provádí správce daně při správě daní, a to zejména ve vztahu k nové právní úpravě ochrany osobních údajů, plynoucí z evropského práva.
One of the method for analysing data available to a tax administrator is data mining. With data mining, it’s possible to find new information and relations hidden until now within available data. Thus, data mining is a useful technique simplifying the tax administration. On the other hand, this mining interferes with taxpayers’ privacy. Moreover, if one considers the subject to be the mining of natural persons’ data, such mining constitutes a processing of personal data. This article focuses on legal regulations concerning data mining of taxpayers and other entities carried by the tax administrator during tax administration, especially in relations to the new personal data protection legislation resulting from European Union law.

Abstrakt Autorka tohoto článku se zabývá problematikou kryptoměn, zejména s ohledem na nejznámější z nich – Bitcoin. Podrobněji se zabývá také odlišností institutů kryptoměna a elektronické peníze, přičemž vymezuje také nevýhody elektronických peněz. Podrobnější analýza je věnována samozřejmě fenoménu Bitcoinu, přičemž za jeho hlavní výhody označuje: a) decentralizovanost, b) neexistenci prostředníka, c) celosvětovost, d) neprolomitelnost, e) nízkou výši transakčních nákladů, f) anonymitu, g) přímou komunikaci bez prostředníka, h) směnitelnost, i) otevřenost kódu. V závěrečné části článku pak autorka nabízí krátký přehled vývoje právní úpravy kryptoměn ve vybraných zemích.
The author of the article deals with issues of cryptocurrencies. the special attention is put on Bitcoin as the most known of them. The difference between legal institutes of cryptocurrency and electronic money is closely analysed, the most important disadvantages of electronic money are described. The most important part of the article contains the analyse of Bitcoin, the author finds the following advantages of Bitcoin: a) decentralisation, b) nonexistence of intermediary, c) globality, d) resistance of break, e) low transfer costs, f) anonymity, g) direct communication, h) exchangeability, i) open code. At the end of the article there is a short overview of legal regulation development of cryptocurrencies in selected countries.

Abstrakt Crowdinvesting, a complex type of crowdfunding and a growing source of alternative finance, uses various equity, debt and hybrid instruments. Some crowdinvesting platforms offer investments through specific financial instruments – special purpose vehicles. As these instruments pool investments of multiple investors in order to invest into a target company, a question of whether these instruments ought to be treated as alternative investment funds becomes relevant. In this article, I provide a basic analysis of the applicability of the Alternative Investment Funds Managers Directive on certain crowdinvesting schemes deploying SPV-structured financial instruments, reaching a conclusion that these financial instruments should not be qualified as alternative investment funds based on a few distinct criteria.
Crowdinvesting, komplexní typ crowdfundingu a rostoucí zdroj alternativních financí, používá různé kapitálové, dluhové a hybridní nástroje. Některé crowdinvestingové platformy nabízejí investice prostřednictvím specifických finanční nástrojů – společností zvláštního určení. Nakolik tyto nástroje slučují investice množství investorů za účelem investování do cílové společnosti, nabízí se relevantní otázka, jestli mají být tyto nástroje posuzované jako alternativní investiční fondy. V článku poskytuji základní analýzu aplikovatelnosti Směrnice o manažérech alternativních investičních fondu na některé crowdinvestingové schéma využívající finanční instrumenty – společnosti zvláštního určení, přičemž dosahuji závěr, že tyto finanční nástroje by se neměli považovat za alternativní investiční fondy na základě několika specifických kritérií.

Abstrakt In the recent time, there have been many initiatives aiming at protection of financial system, depositors and public funds from being used when crisis come along. The most recent economic and financial crisis has shown that there is a need for a new framework dealing with distressed financial institutions in the European Union. Some laws not only did take effect but they were also tested in practice. Bank Recovery and Resolution Directive is such a law. In the current paper, it will be shown how this directive or some provisions and principles thereof are applied in practice and pointed out some perils this process can bring out.

Abstrakt The article in general deals with the issue of enforcement of national rules regulating online gambling in the Internet environment. This issue is described in the light of the recent case law of the Court of Justice of the European Union but also in the light of the ruling of the Constitutional Court of the Czech Republic, which dealt with the compliance of the blocking of websites containing illegal gambling with the Czech Constitutional Order. Investigated topic is discussed in the broader context of Czech and European law, with the emphasis on factual impacts resulting from difficult enforceability in the Internet environment in the area of regulation of online gambling.
